Exemptions for Baker County Filers
Georgia requires its residents to use state bankruptcy exemptions rather than the federal ones. O.C.G.A. 44-13-100 sets the rules. Baker County filers can protect up to $21,500 in home equity. The motor vehicle exemption is $5,000. Personal property is capped at $5,000, with no item above $300. Jewelry is protected up to $500, and tools of the trade up to $1,500.
The wildcard exemption gives Baker County debtors $1,200 to apply toward any asset. Up to $10,000 of unused homestead exemption can be added to it, which makes it useful if you rent instead of own. Fully exempt items include Social Security, veterans benefits, workers comp (O.C.G.A. 34-9-84), unemployment, and alimony or child support. Most retirement accounts are also safe.
You need to have lived in Georgia for at least 730 days before filing to claim these exemptions. Baker County filers who recently moved from another state may need to use that state's rules instead. Under the Bankruptcy Code, this residency requirement applies nationwide.
